Please read these Terms and Conditions ("Terms") carefully before using the Express Beer Delivery mobile application ("the App") operated by MistNex Dynamics (Pvt) Ltd ("we", "us", or "our").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User") and MistNex Dynamics (Pvt) Ltd, a company registered in Zimbabwe. By creating an account or placing an order through the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.
You must be 18 years of age or older to use Express Beer Delivery. The App is a platform for the delivery of alcoholic beverages. Use by anyone under the legal drinking age is strictly prohibited.
By using the App, you represent and warrant that:
We reserve the right to request proof of age at any time — including at the point of delivery. Drivers may refuse delivery if they have reasonable grounds to believe the recipient is under 18 or is intoxicated to a degree that raises a safety concern. In such cases, no refund will be issued for the order.
Express Beer Delivery is a technology platform that connects customers with licensed bottle stores and independent delivery drivers in Harare, Zimbabwe. We facilitate orders and coordinate delivery — we do not manufacture, store, or directly sell alcohol.
The App is currently available in Harare, Zimbabwe. We do not guarantee availability in all areas of Harare or at all times. Service hours may vary by vendor. We reserve the right to restrict or suspend the service at any time without prior notice.
Express Beer Delivery acts as an intermediary marketplace. The sale of alcohol is conducted by licensed vendors, not by MistNex Dynamics (Pvt) Ltd directly. Vendors are independently responsible for the legality and quality of their products.
To place orders you must register for an account. When creating your account you agree to:
You are solely responsible for all activity that occurs under your account. MistNex Dynamics (Pvt) Ltd will not be liable for any loss or damage arising from your failure to maintain account security.
We reserve the right to suspend or permanently terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or vendors.
By submitting an order through the App you are making an offer to purchase the selected products. An order is only confirmed once you receive an in-app confirmation and the vendor accepts the order. We reserve the right to cancel any order before it is accepted, including where products are out of stock.
Product prices are set by individual vendors and are displayed in United States Dollars (USD) unless otherwise indicated. A delivery fee calculated based on the distance between the vendor and your delivery address will be added to your order. All prices include applicable taxes where required by law.
We reserve the right to correct any pricing errors. If a pricing error is discovered after your order is placed, we will notify you and offer you the option to proceed at the correct price or cancel your order.
Express Beer Delivery currently operates on a cash on delivery model. Payment is made directly to the driver upon receipt of your order. Drivers carry change; however, we recommend having the correct amount where possible. We are not responsible for disputes arising from cash transactions between customers and drivers.
Digital payment options may be introduced in future updates. You will be notified of any changes to accepted payment methods.
We aim to complete deliveries within approximately 30 minutes of order acceptance. Estimated delivery times are indicative only and may be affected by factors outside our control, including traffic, weather conditions, vendor preparation time, or high order volumes. We do not guarantee any specific delivery time.
You are responsible for providing a complete and accurate delivery address. If a delivery cannot be completed due to an incorrect address, inaccessible location, or failure to respond, the order may be cancelled and no refund will be issued.
You must be present at the delivery address to receive your order. If you ask the driver to leave the order unattended, you accept full responsibility for it from that point. We are not liable for orders that are left unattended at your request.
If delivery cannot be completed after reasonable attempts to contact you, the driver may return the goods to the vendor. In this case you may be charged a failed delivery fee.
You may cancel your order at no charge only before the vendor has accepted it. Once a vendor has accepted your order and preparation has begun, cancellation may not be possible and may incur a cancellation fee at our discretion.
We reserve the right to cancel any order at any time for reasons including but not limited to: the vendor being unable to fulfil the order, items being unavailable, or concerns about the validity of the order.
Refunds will be considered in the following circumstances:
Refund requests must be submitted within 24 hours of the delivery by contacting us at support@expressbeerdelivery.co.zw with your order number and a description of the issue. We may request photographic evidence. Approved refunds are issued at our sole discretion and will be processed within 5–7 business days.
Refunds are not available simply because you changed your mind, the products were not to your taste, or delivery took longer than estimated.
When using the App you must not:
Violations of this section may result in immediate account termination and may be reported to relevant authorities where required by law.
All content, design, code, trademarks, logos, and materials in the App are the intellectual property of MistNex Dynamics (Pvt) Ltd or our licensors and are protected by applicable copyright and trademark laws. The "Express Beer Delivery" name, logo, and branding are trademarks of MistNex Dynamics (Pvt) Ltd.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to copy, modify, distribute, sell, or exploit any App content.
To the fullest extent permitted by law, MistNex Dynamics (Pvt) Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or the services provided through it.
Our total liability to you in connection with any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the specific order giving rise to the claim.
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's availability, accuracy, reliability, or fitness for a particular purpose. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
These Terms are governed by and construed in accordance with the laws of Zimbabwe. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
We reserve the right to modify these Terms at any time. When we make changes we will update the "Last updated" date at the top of this page. For material changes, we will notify you via the App or by email at least 7 days before the changes take effect.
Your continued use of the App after changes become effective constitutes acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the App.
We will always keep a record of previous versions of these Terms and make them available on request.
